MCP CONNECTOR SUPPLEMENTAL TERMS

These MCP Connector Supplemental Terms (“MCP Terms“) are Supplemental Terms under Section 2(a) of the Kit, Inc. Terms of Service available at https://kit.com/terms (“Terms of Service“). These MCP Terms supplement and are incorporated into the Terms of Service and apply specifically to your access to and use of the Kit MCP Connector (defined below). All capitalized terms not defined in these MCP Terms have the meanings set forth in the Terms of Service.
In accordance with Section 2(a) of the Terms of Service, these MCP Terms control over any conflicting or inconsistent provisions in the Terms of Service solely with respect to the Kit MCP Connector.
By connecting or using the Kit MCP Connector, you acknowledge that you have read, understood, and agree to be bound by these MCP Terms and the Terms of Service.
“AI Client” means any third-party artificial intelligence application or platform (including, without limitation, Claude Desktop, ChatGPT, Cursor, and Windsurf) that you connect to your Kit account via the Kit MCP Connector.
“AI Client Provider” means the operator or developer of an AI Client.
“Kit MCP Connector” or “MCP Connector” means the Kit-published Model Context Protocol server that enables you to access and manage your Kit account through natural language commands issued via an AI Client, including all associated tools, prompt templates, and API wrappings made available by Kit from time to time.
“MCP Tools” means the individual read and write functions exposed by the Kit MCP Connector, including those covering subscribers, broadcasts, tags, forms, sequences, segments, purchases, custom fields, webhooks, email templates, landing pages, and account settings.
“Prompt Templates” means the guided workflow templates made available through the Kit MCP Connector (for example, “Account Overview,” “Broadcast Performance,” and “Tag Cleanup Audit”).
“Transmitted Data” means any Kit account data, including subscriber information, broadcast content, tags, purchase records, custom fields, and any other information, that is transmitted from Kit’s systems to an AI Client or AI Client Provider in connection with your use of the Kit MCP Connector.
2.1 Authorized Use. The Kit MCP Connector is an authorized use of Kit’s API under the Terms of Service. Your access to and use of the Kit MCP Connector is subject to the Terms of Service (including Kit’s Acceptable Use Policy), these MCP Terms, and any rate limits, access controls, or other restrictions Kit applies to API usage from time to time.
2.2 Account Security. You are responsible for all actions taken through your Kit account via the Kit MCP Connector, including actions initiated by an AI Client on your behalf, to the same extent as if you had taken those actions directly. Section 5 of the Terms of Service (Your Account, Account Security) applies in full to MCP Connector usage.
2.3 Organizational Use. If you connect the Kit MCP Connector on behalf of an Organization as defined in the Terms of Service, you represent and warrant that you have authority to bind that Organization to these MCP Terms.
3.1 Creator Responsibility for Third-Party Data Flows. When you connect an AI Client to your Kit account via the Kit MCP Connector, Transmitted Data will leave Kit’s systems and be processed by the applicable AI Client Provider. Kit’s Privacy Policy, Data Processing Addendum, and other data protection commitments govern Kit’s own processing of your data. They do not govern, and Kit is not responsible for, the collection, use, storage, or disclosure of Transmitted Data by any AI Client Provider once that data has left Kit’s systems.
3.2 Your Acknowledgment. By connecting an AI Client, you expressly acknowledge and agree that:
3.3 Subscriber Data. You acknowledge that the Kit MCP Connector’s read-scope tools may surface subscriber personal data (including email addresses, tags, purchase history, and custom fields). As the data controller for your subscribers’ personal data, you are responsible for ensuring that any transmission of subscriber data to an AI Client Provider is consistent with applicable data protection laws, your privacy notices to subscribers, and any consents you have obtained.
3.4 No Kit Liability for Third-Party Processing. To the maximum extent permitted by applicable law, and in addition to the limitations in Section 20 of the Terms of Service, Kit shall have no liability arising out of or related to the processing of Transmitted Data by any AI Client Provider.
4.1 Nature of Write Operations. The Kit MCP Connector includes write-scope MCP Tools that allow an AI Client to take actions in your Kit account, including modifying or deleting subscribers, sending broadcasts, editing sequences, creating or removing tags, and managing webhooks. These actions are initiated based on natural language instructions interpreted by the AI Client and may be difficult or impossible to reverse.
4.2 Your Assumption of Risk. You expressly acknowledge and agree that:
4.3 Recommended Precautions. Kit strongly recommends that before using write-scope MCP Tools for bulk or irreversible operations, you export a current backup of affected data using Kit’s native export functionality. Kit is not obligated to restore data affected by AI-initiated write operations.
5.1 Nature of Prompt Templates. Prompt Templates are provided as suggested starting points for common workflows. They are illustrative guides, not guaranteed-accurate instructions, and their output will vary depending on your Kit account data, the AI Client in use, and the AI Client’s interpretation of the template.
5.2 No Warranty on Template Output. Kit makes no representation or warranty that any Prompt Template will produce accurate, complete, or suitable results for your specific use case. Prompt Template output does not constitute advice from Kit. You are solely responsible for reviewing and validating any actions recommended or taken as a result of using a Prompt Template.
5.3 Changes to Prompt Templates. Kit may add, modify, or remove Prompt Templates at any time without notice.
6.1 Compliance with Existing Policies. Your use of the Kit MCP Connector is subject to Kit’s Acceptable Use Policy (available at https://help.kit.com/en/articles/3038130-acceptable-use-policy), Section 12 of the Terms of Service (Prohibited Conduct and Content), and all other applicable Kit policies, in each case as updated from time to time.
6.2 API Rate Limits. The Kit MCP Connector wraps Kit’s API. All rate limits, throttling, and access controls applicable to the API usage apply equally to MCP Connector usage. Kit reserves the right to suspend or throttle your MCP Connector access if your usage exceeds applicable limits or negatively affects Kit’s systems or other users.
6.3 No Automation of Prohibited Conduct. You may not use the Kit MCP Connector, including any AI Client, to automate any action that would be prohibited under the Terms of Service if taken directly.
Kit may modify, update, suspend, or discontinue the Kit MCP Connector or any MCP Tools or Prompt Templates at any time and for any reason, with or without notice, consistent with Section 25 of the Terms of Service. Kit will use commercially reasonable efforts to provide advance notice of material changes where practicable.
IN ADDITION TO THE DISCLAIMERS IN SECTION 19 OF THE TERMS OF SERVICE, WHICH ARE FULLY INCORPORATED HEREIN, KIT SPECIFICALLY DOES NOT WARRANT THAT: (A) THE KIT MCP CONNECTOR WILL FUNCTION WITHOUT ERROR OR INTERRUPTION WITH ANY PARTICULAR AI CLIENT; (B) PROMPT TEMPLATES WILL PRODUCE ACCURATE OR SUITABLE RESULTS; (C) WRITE OPERATIONS EXECUTED VIA AN AI CLIENT WILL REFLECT YOUR INTENT; OR (D) ANY AI CLIENT PROVIDER WILL HANDLE TRANSMITTED DATA IN ANY PARTICULAR MANNER.
THE LIMITATIONS OF LIABILITY IN SECTION 20 OF THE TERMS OF SERVICE APPLY IN FULL TO ALL CLAIMS ARISING OUT OF OR RELATED TO THE KIT MCP CONNECTOR, INCLUDING CLAIMS RELATED TO WRITE OPERATIONS, PROMPT TEMPLATE OUTPUT, DATA TRANSMISSION TO AI CLIENT PROVIDERS, AND AI CLIENT MISINTERPRETATION OF INSTRUCTIONS.
10.1 Relationship to Terms of Service. These MCP Terms are Supplemental Terms under Section 2(a) of the Terms of Service and are fully incorporated into the Terms of Service. All provisions of the Terms of Service not expressly modified by these MCP Terms remain in full force and effect.
10.2 Updates to These MCP Terms. Kit may update these MCP Terms from time to time in accordance with Section 2(b) of the Terms of Service. Continued use of the Kit MCP Connector after notice of changes constitutes your acceptance of the updated terms.
10.3 Entire Agreement for MCP Connector. These MCP Terms, together with the Terms of Service, Privacy Policy, and Data Processing Addendum (if applicable), constitute the entire agreement between you and Kit regarding the Kit MCP Connector and supersede all prior or contemporaneous understandings regarding the same.
10.4 Survival. In addition to the provisions identified in Section 25 of the Terms of Service that survive termination, Sections 3 (Data Transmission to Third-Party AI Clients), 4 (AI-Mediated Write Operations), 8 (Disclaimers), and 9 (Limitation of Liability) of these MCP Terms shall survive any termination or expiration of your relationship with Kit.
